Scottish Government consults on Permitted Development Rights to boost housing supply

The Scottish Government has launched a public consultation seeking views on expanding permitted development rights (PDR) to accelerate the delivery of new homes across Scotland.

The consultation, open until 27 October 2025, is part of the government’s wider strategy to address the housing shortage, particularly in rural areas and town centres.

Permitted development rights allow certain types of construction, alterations, or changes of use to proceed without full planning applications, streamlining regulatory processes. The consultation explores a range of options, including:

  • expanding PDR for conversion of agricultural and forestry buildings into residential properties, potentially allowing larger floor areas and extensions
  • introducing new PDR for demolition and redevelopment of redundant rural buildings
  • enabling residential conversion of upper floors and ground floors in town and city centres, aiming to rejuvenate underused urban spaces; and
  • revising PDR for householder developments and low-carbon installations such as air source heat pumps.

For building engineers, the proposals could significantly impact project workflows. Reduced planning requirements may speed up project delivery, lower administrative costs, and increase flexibility in design and material selection. However, engineers may also face new challenges around ensuring compliance with building standards, environmental safeguards, and structural integrity when developments proceed under more permissive rules.

The consultation is accompanied by a Strategic Environmental Assessment and a partial Business and Regulatory Impact Assessment, which highlight both the potential benefits of faster housing delivery and the risks, including impacts on heritage, amenity, and local ecosystems.

Industry stakeholders are encouraged to review the proposals and provide feedback, which will inform any legislative changes to the Town & Country Planning (General Permitted Development) (Scotland) Order 1992. If adopted, the changes could come into effect as early as 2026, offering building engineers new opportunities and responsibilities in shaping Scotland’s housing landscape.
